  • The conservator is legally responsible for the conservatee's well-being and/or finances, and their actions are subject to court supervision.

  • It involves creating a plan, often including legal documents like wills and trusts, to ensure that a person's wishes are carried out regarding their property, finances, and healthcare decisions, especially in cases of incapacity or death. 

Guardianships

Refers to the process where a court appoints an individual or entity (the guardian) to make decisions and care for another person (the ward) who is unable to do so for themselves, either due to age (minority) or incapacity (incapacitated adult). 
  • The guardian assumes responsibility for the ward's personal care, medical treatment, financial affairs, or a combination of these, depending on the type of guardianship established. 

Probate Matters

In a legal context, probate is the court-supervised process of administering the estate of a deceased person. 

  • This involves validating the deceased's will (if one exists), identifying and managing their assets, paying outstanding debts and taxes, and ultimately distributing the remaining assets to the beneficiaries according to the will or, if there is no will, according to state law.
